DavOr Holds First Public Auction for Delinquent Real Properties

The Provincial Government of Davao Oriental through its constituted Public Auction Committee (PAC) successfully held its first Public Auction Sale of identified delinquent real properties in the province, held at the Capitol Covered Court, Capitol Hills, City of Mati.

Out of the 500 delinquent real properties identified by the PAC since 1994, only 4 properties, all of which are agricultural lands, were put up for bidding. The successful bidders for 3 of these properties will be awarded a Certificate of Sale, while the remaining unsold property will be subject to a Declaration of Forfeiture. The Post-Auction Sale activities will promptly follow, conducted by the Office under the prescribed guidelines and procedures.

This Administrative Action, authorized by the law, specifically under Sections 172-174, 176-182, Chapter 4, Book II of Republic Act No. 7160 or the Local Government Code of 1991, enables the imposition of levies on real properties with outstanding taxes.

Once these vital funds are collected, they will be utilized to execute a range of government programs and projects aimed at substantially enhancing the well-being of the larger community.

However, based on the guidelines, owners or individuals with legal interests in the real properties auctioned off will have the opportunity to reclaim their assets by fully settling delinquent taxes, including interests and the cost of sale. Throughout the one-year redemption period, they will maintain possession of the properties and continue to enjoy any income or proceeds generated.

Noting that โ€œtaxes are the lifeblood of the government and should be collected without unnecessary hindrance,โ€ the Provincial Government, through the Provincial Treasurerโ€™s Office, availed of this civil remedy for the collection of delinquent real property taxes.

The provincial government asserts that this decision follows extensive consultations with all stakeholders and the Bureau of Local Government Finance XI. Despite the amnesty granted for the payment of interests, penalties, and surcharges on overdue real property taxes over three consecutive years (from 2019 to 2021), allowing ample time and opportunity for concerned owners, administrators, beneficiaries, and other stakeholders to settle their accounts with the Provincial Government, the cumulative amount of outstanding tax revenues has persisted, causing adverse psychosocial effects among taxpayers. Hence, a decisive solution is imperative.

In the upcoming year, the Provincial Government will launch the second phase of the Public Auction Sale of delinquent real properties. This initiative represents a resolute measure to enforce tax collection, compelling taxpayers to address and settle their outstanding obligations with the government.

Present during this significant event are the esteemed members of the PAC chaired by Atty.
